Following a successful career as Cara Dune in Disney’s ‘The Mandalorian’ in recent times, Gina Carano is in the news for a different reason altogether. The famous actress is suing Disney following her unfair dismissal from the franchise.

Following a series of controversial social media posts in which Carano compared anti-vaxers to Jews, and after she touched upon other sensitive topics that aren’t quite in tune with modern sensibilities and the image that Disney is trying to maintain, she was fired or rather, as others argue, her contract was never renewed.

This all led to a lawsuit reportedly financed by Elon Musk, who offered to legally fund any employee who feels discriminated against due to his or her worldviews in a place of employment. Carano is currently suing Disney for $ 75,000, and she wants to be rehired by Lucasfilm.

Disney filed a motion to dismiss the lawsuit and the motion was recently rejected. California-based Judge Sherilyn Peace Garnett ruled that Disney failed to provide evidence that they employ contractors for the purpose of maintaining a good public image:

Defendants have not identified any evidence—in the Complaint or otherwise—to substantiate a claim that they employ public-facing actors for the purpose of promoting the ‘values of respect,’ ‘decency,’ ‘integrity,’ or ‘inclusion. […] Accordingly, Defendants’ invocation of the supposedly detrimental effects of Plaintiff’s ‘mere presence’ as one of Defendants’ employees lacks constitutional import.

At this stage in the litigation, the Court cannot conclude, as Defendants urge it to, that Plaintiff’s continued employment by Defendants would inhibit or intrude upon Defendants’ rights to expressive association.

Now the lawsuit is clearly heading toward a trial or settlement, and Carano couldn’t be happier about it.

In a recent social media post, the actress stated that she is “moved to tears” by the latest legal developments.

What happened to me was unacceptable, absurd and abusive, among other things. It should not have happened to me, and it should not happen to anyone else moving forward. Let it stop here. I quite literally fought to get to where I got to in my career through intense ups and downs, and I’ll keep up that fight to continue doing what I love. I appreciate all of you who stood by me and defended me, and I am so sorry that similar situations have happened to some of you. I want you to know that I see you and I stand with you.

The actress continued by stating how grateful she is to Elon Musk, for providing her with the opportunity to sue Disney:

Thank you to @elonmusk , a man I have never even met, who so graciously gave me a fighting chance. Thank you for standing for justice for all of humanity. May God bless you and your family for years to come because He has chosen you for such a time as this.

Carano still has a long legal fight in front of her, this is just a small victory in the long run, but at least the court recognized that she had a right to sue her former employer.
