‘Crime 101’ Star Halle Berry’s Family Court Battle Intensifies as Daughter Nahla May Testify
Halle Berry and ex-husband Olivier Martinez, both 60, are in the middle of a contested hearing at Los Angeles County Superior Court over a domestic violence restraining order and custody of their 13-year-old son.
Martinez filed seeking sole custody, alleging Berry physically assaulted their son during an incident he says took place on September 26, 2026. A temporary restraining order has remained in place while the matter is heard.
Berry denies the allegations. Her attorney has described the claims as entirely meritless and deliberately misleading, and Berry has characterized the incident as roughhousing that turned tense rather than an act of abuse. She has also alleged that Martinez misrepresented what happened and has interfered in her relationship with their son.
The couple’s son testified for close to 4 hours on Monday, October 19. That testimony was given behind closed doors, and its contents have not been made public. Both Berry and Martinez are scheduled to testify. The witness list also includes Berry’s fiancé Van Hunt, school employees, therapists and medical professionals.
Berry’s 18-year-old daughter, Nahla Aubry, whom she shares with model Gabriel Aubry, has been listed as a potential witness. Page Six first reported that she is expected to testify virtually because she is currently in school. Martinez’s side had previously objected to her taking the stand.
Nahla submitted a written declaration to the court on October 3 in support of her mother. In it, she stated she had never seen Berry hit, slap, choke, grab, or physically abuse her half-brother, and specifically denied witnessing any conduct matching the allegations.
She described Berry as a loving and devoted parent and said she had never observed anything abusive in her mother’s parenting. She also said Berry had never spoken negatively to her or her brother about either Martinez or Gabriel Aubry.
The two legal teams have clashed over what evidence should be admitted. Martinez’s attorneys argued that Berry’s declarations are riddled with hearsay and should be excluded. Berry’s attorneys have defended the filings and have raised questions about the reliability of some of the testimony in arguing for which witnesses should be called.
No ruling has been reported on the restraining order or on custody. The allegations are disputed and have not been established in court, and the son’s testimony remains sealed. Separately, Berry recently confirmed her engagement to Van Hunt, who is among the listed potential witnesses.
