Piccolo’s lawyer called Disney’s argument “preposterous,” asserting that it’s unfair to deny a jury trial based on a Disney+ subscription. Disney countered by stating that the restaurant isn’t owned or operated by them, and they’re merely defending against being included in the lawsuit. Piccolo is seeking damages under Florida’s Wrongful Death Act for mental pain, loss of companionship, and other expenses.

To clarify Disney’s court argument: they claimed that because Piccolo was a Disney+ subscriber, he agreed to Disney’s Terms of Service, which mandates third-party arbitration and excludes lawsuits, particularly jury trials that often favor individuals over corporations.
